ABSTRACT

Crime against women are rising in India especially in State of Uttar Pradesh, Madhya Pradesh and Delhi and there is a need felt in every corner of India to enhance punishment to deter these crimes. India is signatories to various International treaties including related to protection of human rights of woman and children. Hon’ble Supreme Court of India and various High Courts has taken cognizance of situation on many occasions and recommended to Union of India and state Governments to amend the law to protect the faith of common man especially vulnerable groups like woman and children. A Critical review of decisions of courts has been done for highlighting the legal situation on the issue of meaning and scope of applicability of section 354 IPC. Data base collected and compiled from the National Crime Record Bureau website to understand the rising trend of crime. This paper discusses various reasons for less punishment for molestation and need for enhanced punishment and making it non-bailable to make sense in preventing rising crimes against woman.

ABSTRACT

Due to rise in crowds naturally there is fall in cultural values and escalation in crimes. Crime against women is on the rise especially sexual crimes. Though crime is prevalent in every country and society, most of them either goes undetected or unreported. As per National Crime Records Bureau (NCRB), New Delhi, a crime take place every 17 seconds, among them one dowry death every 77 minutes, one crime against women every 3 minutes and finally one rape or sexual assault every 27 minutes. With above crime scenario, Forensic Medicine plays an important role in helping to prevent, early detection, providing expert medicolegal and scientific reports at earliest, which will result in quick trial and instant administration of justice to victims. Due to lack of legal or medicolegal and scientific awareness and knowledge among victims, investigating agencies, medical and paramedical staff, the end result is either ‘justice hurried is justice buried’ or ‘justice delayed is justice denied’ to the victim. There is need to give importance to Forensic Nursing, impart medicolegal knowledge to paramedical and health workers in rural and semi-urban levels as to how to handle case of crimes committed against women and report them. One accused acquitted means breeding of hundred criminals. Prevention and detection is better than conviction.

El proyecto de investigación se orienta a describir y comparar la legislación constitucional, civil, de familia, laboral y penal relativa a las mujeres de (10) países de América Latina, haciendo énfasis en el aspecto sociológico de la legislación, confrontando la normativa con los datos estadísicos desde una perspectiva de género. Objetivo General: Discutir la legislación sobre mujeres en (10) países de América Latina, haciendo un análisis comparativo. Objetivos Específicos: a) Recopilar la principal legislación sobre las mujeres en (10) diez países de América Latina en las materias constitucional, civil, laboral, penal y de familia. b) Comparar la legislación señalada y confrontarla con la situación real que enfrentan las mujeres en esos países. Planteamiento del problema: Cuál es el estado de la situación de la normativa legal sobre mujeres en diez países de América Latina, señalando las similitudes y diferencias entre ellos y evaluando la correspondencia entre la situación real que viven las mujeres y la legislación discutida?.....
